Terms and Conditions
Effective Date: 5th December 2025
1. Definitions:
Unless otherwise indicated, the following capitalized terms have the following meaning:- Platform or Service: Refers to the https://www.anchors.in/ website operated by ALPHAHIVE ANCHORS PVT LTD ("anchors," "we," "us," or "our").
- Creator(s)/Influencer(s): Individuals or entities, and their authorized agents or employees, using the Service for purposes including but not limited to creating media kits, participating in marketing campaigns, and creating content.
- Brand/Company: Companies or their representatives, including any authorized agents or employees, using the Service for purposes including but not limited to collaborating with Influencers.
- User/Users ("you", "You", "Your"): Refers to any individual accessing or using the Platform/Service, whether as a Creator/Influencer or a Brand/Company representative. This term also includes any entity on whose behalf an individual accesses the Platform/Service.
- Subscription(s): Refers to the selected payment plan by which the User gains access to the Service. Billing occurs in advance and may be on a one-time or recurring, periodic basis ("Billing Cycle").
- Campaign(s): Refers to a marketing initiative created by a Brand and executed by a Creator/Influencer, including all associated activities, deliverables, timelines, and performance metrics
- Content/Data: Refers to data, information, and materials provided by the User on the Service, including personal information and usage data collected through the Platform.
- Credits: Represent a form of prepaid value within the Platform, purchased by the Company alongside a Subscription. Credits remain valid for use as long as the Subscription is active, unless otherwise stated.
- Model: Defines the method chosen by the User to execute a campaign, either fixed or performance-based.
- Fixed Model: Available on custom request, this option allows a Brand to run a Campaign with predetermined rates for influencers, irrespective of the campaign's performance. Budget utilization is fixed and not contingent on campaign outcomes.
- Performance-based Model: The default setting where the Brand pays for the Campaign based on actual results. The budget is used in accordance with the Campaign's performance, and any unused funds are returned as Credits for future Campaigns.
2. Acceptance of Terms:
By accessing or using the Service, the User agrees to abide by these terms and conditions.
3. Subscription & Payment:
- The Service is available on a subscription basis chosen by the User.
- Users agree to pay all fees associated with their chosen Subscription plan.
- Subscription payments are non-refundable, except as required by law or explicitly stated in these terms, as well as in our Cancellation and Refund Policy
- Pre-payment for Campaigns: Company must pay the entire Campaign amount before it goes live. The Platform disburses these funds to Creator after the Campaign duration ends. Refunds, if applicable, are issued as Credits according to the selected Model within 15 business days after a Campaign ends.
- Refunds for Non-participation: If a Creator cannot participate in a Campaign and the Company has already made payment, a refund will be issued as Credits, regardless of the chosen Model.
- Credit Utilization: Company may utilize some or all of their Credits in Campaign, as needed and and can purchase additional Credits from the Platform.
- Fee Changes: The Platform may modify subscription fees at any time. Any changes will take effect after the current Billing Cycle ends. Users will be provided reasonable notice of these changes, as defined in the Cancellation and Refund Policy, to decide whether to continue their Subscription.
- Consent to Fee Changes: Continued use of the Service after a Subscription fee change implies consent to the new fee amount.
- Creator Commissions: Creators are charged a commission of 5–25% per collaboration, determined by factors such as collaboration value, operational effort, and economies of scale. The commission structure is standardized across the Platform and is applied solely to support operational costs and continued service quality.
- Creator Payouts: Payouts to Creators are processed within 15 business days following the end of the Campaign duration.
4. Trial Access:
- The Service may offer trial access to Users.
- Granting trial access is at the sole discretion of the Platform, based on internal criteria.
- Trial access can be terminated at any point without prior notice.
5. Termination & Access:
The Service reserves the right to cancel any User's Subscription and deny access if the User violates any terms. Either party may terminate the Service with prior notice. Upon termination, Users will no longer have access to the Service.
6. Services & Usage:
- The Service facilitates connections between Users for marketing campaigns.
- The Platform does not guarantee campaign success or specific outcomes.
- Users shall not use the Service for illegal or unauthorized purposes. Breach or violation will result in immediate termination of the User's Subscription and account.
7. Data & Privacy:
- User data will be stored and processed in accordance with our Privacy Policy.
- The Service retains the right to analyze and use aggregated, anonymized data for research and development purposes.
- We collect personal data and usage data to improve our Service. Personal data includes information such as names, email addresses, and LinkedIn profiles. Usage data includes details such as page visit duration and interactions with the Platform.
8. Limitation of Liability:
- The Service, its employees, or affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
- Content & Regulatory Compliance Responsibility :
- All Users (as defined herein), are solely and exclusively responsible for ensuring that any content, promotions, endorsements, representations, marketing activities, or claims made or disseminated through the Platform comply with all applicable laws, regulations, industry standards, and guidelines in and outside India (including, without limitation, those issued by SEBI, RBI, MCA, ASCI, FSSAI, or other relevant authorities).
- The Platform may, for operational convenience or at the request of a User, assist in facilitating draft reviews, communication, or campaign coordination. However, such assistance shall not be construed as the Platform assuming responsibility for verifying the accuracy, legality, compliance, or regulatory appropriateness of any content.
- All legal, regulatory, and compliance obligations related to the content rest solely with the User who creates, requests, or authorizes such content.
- The Platform and its employees, directors, agents, or affiliates shall not be liable for any non-compliant, misleading, inaccurate, or unlawful content published or promoted through the Service, nor for any penalties, regulatory actions, or damages arising therefrom.
9. Force Majeure:
The Service is not responsible for cases of force majeure, such as failure, suspension, or interruption of services or use of the Platform, as a result of blocking the internet network, actions, or omissions of third parties, or any other causes or circumstances independent of our will that prevent the normal use of the Platform.
10. Severability:
If any provision of these terms of use is held to be unenforceable, the enforceability of the remaining provisions shall in no way be affected or impaired thereby.
11. Warranties & Disclaimers:
- The Service is provided "as is."
- The Service makes no warranties regarding the accuracy or completeness of any Content or the results obtained from using the Service.
12. Indemnification:
Users agree to indemnify and hold harmless the Service and its employees and affiliates from any claim or demand made by any third party due to their breach of these terms or violation of any law.
13. Waiver:
The failure of us to enforce or to exercise at any time or for any period any term of or any right pursuant to these terms of use shall not be construed as a waiver of any such right and shall in no way affect our right later to enforce or exercise it.
14. Governing Law & Jurisdiction:
These terms are governed by the laws of India. Disputes arising out of these terms will be subject to the exclusive jurisdiction of courts in Noida, India.
15. Amendments:
The Service reserves the right to modify these terms at any time. The latest version will always be posted on our platform, with the effective date at the top. Continued use of the Service indicates acceptance of the updated terms. We encourage you to review this policy periodically.
16. Compliance with Information Technology Act, 2000 (IT Act):
According to IT Act, we comply with the following:
- Personal information is collected for defined purposes and undergoes lawful processing.
- Consent is obtained clearly and transparently, with provisions for Users to withdraw at any time.
- Data is securely stored and retained only as long as necessary for its intended purpose or as required by law.
- Strong security measures are implemented to prevent unauthorized access and data breaches.
- Users can access and rectify their data, ensuring accuracy and up-to-dateness.
- Information is disclosed to third parties only for legitimate purposes, in line with our privacy policy.
- We commit to notifying users and authorities timely if a data breach occurs.
17. Acknowledgement:
BY USING SERVICE OR OTHER SERVICES PROVIDED BY US, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
